Safety Belts/Child Restraints

What is the Illinois safety belt law?

With exceptions, each driver and front seat passenger of a motor vehicle operated on a street or highway shall wear a properly adjusted and fastened seat safety belt. If the driver is under the age of 18, every passenger under the age of 19 must be properly secured. A child less than 8 years of age shall be protected by the Child Passenger Protection Act. For safety, motorists and passengers should always wear their safety belts.

What is the Child Passenger Protection Act?

Children under the age of 8 years must be secured in an appropriate child restraint system, more commonly called a child safety seat. Child safety seats include infant seats, convertible seats (rear-facing for infants and forward-facing for toddlers) and booster seats that are used with the vehicle lap and shoulder belt system.

Children and young people ages 8 years to under 16 years must be secured in a properly adjusted safety belt in any position in the vehicle.


Curfew Laws:

Curfew Applies to Everyone under the age of 18 :

1. Between 12:01 a.m. and 6:00 a.m. Saturday;
2. Between 12:01 a.m. and 6:00 a.m. Sunday;    and
3. Between 11:00 p.m. on Sunday to Thursday, inclusive, and 6:00 a.m. on the following day.


Graduated Driver Licensing Laws:

Permit Phase- Drivers Age 15

Night time driving restrictions (Sunday-Thursday, 10pm-6am; Friday-Saturday, 11pm-6am)

Number of passengers limited to one in the front seat and the number of seat safety belts in the back seat.

All occupants under age 19 must wear seat safety belts.

Cell phone use while driving is prohibited for drivers under age 19, except in the case of emergency to an emergency services agency.

Initial Licensing Phase- Drivers Age 16-17

Night time driving restrictions- (Sunday-Thursday, 10pm-6am; Friday-Saturday, 11pm-6am.

All occupants under age 19 must wear seat safety belts

For the first 12 months of licensing, or until the driver turns 18, the number of passengers is limited to one person under age 20, unless the passenger(s) is a sibling, stepsibling, child or stepchild of the driver.  After this period, the number of passengers is limited to one in the front seat and the number of seat safety belts in the back seat.

Cell phone use while driving is prohibited for drivers under age 19, except in the case of an emergency to an emergency services agency.

Full Licensing Phase- Drivers Ages 18-20

No age-related restrictions apply except in cases where a driver fails to move from the initial licensing phase to the full licensing phase.
